1. Who you are contracting with
Our websites serve two separate legal entities under the Real Health
Diagnostics, HTMA Test, DUTCH Test and
GI-MAP Test brands:
- Real Health Diagnostics inc., a Canadian federal corporation,
serves Canadian orders. Its public mailing address is 5307 Victoria Drive #1343,
Vancouver, British Columbia V5P 3V6, Canada.
- Real Health Diagnostics USA Inc., a Florida corporation and
wholly owned subsidiary of Real Health Diagnostics inc., serves United States
orders. Its principal business and mailing address is 317 Stonehurst Parkway,
Saint Augustine, Florida 32092, United States.
These Terms are an agreement between you and the legal entity identified as the
seller before you pay and on your order confirmation. In these Terms, "we", "us"
and "our" mean that seller. The website brand or payment currency alone does not
identify the seller. If the seller shown does not match the country in which you
are ordering the service, contact us before paying.
Orders placed before the United States business began accepting payments remain
with the seller identified for the original order. The launch of the subsidiary
does not transfer an existing order or change who owes a refund.
These Terms apply across our websites:

htmatestcanada.com · htmahairtest.com · dutchtestcanada.com ·

Our Privacy Policy, Refund Policy and Shipping Policy form part of these Terms and
are incorporated by reference.
2. What we provide
We sell at-home laboratory test kits and the analysis of samples you collect
yourself, together with written interpretation of your results where you have
purchased it.
Samples are analysed by independent CLIA-certified laboratories:
- Hair tissue mineral analysis (HTMA): Trace Elements, Inc., 4501 Sunbelt Drive,
Addison, Texas 75001, USA
- Hormone testing (DUTCH): Precision Analytical Inc., 3138 NE Rivergate Street,
McMinnville, OR 97128, USA
- Stool testing (GI-MAP): Diagnostic Solutions Laboratory, LLC,
5895 Shiloh Road, Alpharetta, GA 30005, USA
How the order is placed. For DUTCH and GI-MAP testing we coordinate orders placed on your behalf by our independently contracted practitioner. The laboratory accepts the sample on the authority of the practitioner’s order rather than directly from you. This is why we ask for date of birth and biological
sex, and it is part of the reason samples cannot be accepted from certain states
(see clause 4.3).
By placing an order you consent to your sample and the personal information
associated with it being transferred to and processed by the relevant laboratory,
including in the United States. How we handle that information is described in our
Privacy Policy.
3. This is not medical care
Our services are for informational and educational purposes only. They are not a
medical diagnosis, and they are not a substitute for the advice of a licensed
healthcare professional.
We do not diagnose, treat, cure or prevent any disease. Nothing we provide should
be used to start, stop or change any treatment or medication. Always consult a
qualified healthcare provider about your health, and seek immediate medical
attention for urgent symptoms — do not wait for test results.
4. Eligibility and geographic limits
4.1 You must be at least 18 years old, or ordering as the parent or legal
guardian of the person the test is for.
4.2 You must provide accurate information about yourself or the person tested,
including date of birth and biological sex where requested, since results are
interpreted against reference ranges that depend on them.
4.3 Laboratory acceptance restrictions. Because of state laws governing
direct-to-consumer laboratory testing, our partner laboratories cannot accept
samples from residents of New York, New Jersey or Rhode Island, and no
laboratory paperwork may list an address in those states. If you are a resident of,
or provide a shipping or mailing address in, one of those states, we cannot provide
the service. We will cancel the order and refund it in full, with no administration fee
deducted. You confirm at checkout that you are not ordering from a restricted state.
4.4 We serve customers in Canada and the United States. We do not currently
accept orders from other countries.
5. Ordering and payment
Prices are shown in the currency indicated at checkout and include applicable taxes
where stated. Payment is processed by Stripe; we do not store your card details.
The seller's full legal name, the payment currency and the total payable are
shown before you confirm payment. Payment options depend on your country, the
items ordered and the payment provider's approval. Klarna, Affirm or Afterpay is available
only when offered at checkout. Any instalment agreement is with that provider
under the terms it shows you; selecting it does not change the seller of your order.
HSA or FSA payment is available only where supported for the particular order.
Accepting a card or providing a receipt does not determine whether an expense is
eligible for reimbursement. Check your plan's requirements, including any medical
necessity documentation, with your plan administrator. We do not guarantee that
every test, package or review service qualifies.
Each test is for one person. If you order more than one, you will be asked for each
person's details after payment.
6. Your responsibilities in collecting the sample
Test accuracy depends on you following the collection instructions we send you.
You are responsible for collecting the sample as instructed, completing the
laboratory submission form accurately, and posting the sample to the laboratory
within any timeframe stated in your instructions.
If a sample is insufficient, contaminated, incorrectly labelled, or arrives in a
condition the laboratory cannot process, a repeat test may be required. See our
Refund Policy for what happens in that case.
7. Turnaround
Results are typically available 10–14 days after the laboratory receives your
sample. This is an estimate, not a guarantee. Postal delays, customs processing and laboratory volumes can extend it.
8. Limitation of liability
To the fullest extent permitted by law, our total liability to you for any claim
arising out of or relating to these Terms or the services is limited to the amount
you paid for the order giving rise to the claim.
We are not liable for indirect or consequential loss, or for any decision you or
anyone else makes on the basis of your results. Nothing in these Terms limits
liability that cannot lawfully be limited, including liability for death or
personal injury caused by negligence, or for fraud.
9. Governing law
For orders sold by Real Health Diagnostics inc., these Terms are governed by the
laws of the Province of British Columbia, Canada, without regard to its
conflict-of-law provisions, and the courts of that province have jurisdiction.
For orders sold by Real Health Diagnostics USA Inc., these Terms are governed by
the laws of the State of Florida and applicable United States federal law, without
regard to conflict-of-law provisions, and the courts in Florida have jurisdiction.
Nothing in these Terms limits any consumer-protection right you have under the laws
of your place of residence that cannot be waived by agreement.
10. Changes
We may update these Terms. The version in force when you place an order is the one
that applies to that order. Material changes will be posted on our websites with a
revised date.
